1. The exclusive use of the Clubhouse and its facilities (excluding the
office and storage room) is available to all Association members on a rental
basis. The swimming pool, pool area, tennis courts, bathhouse, etc. are not
available for rent.
Access to these areas defined above is prohibited as part of the rental.
2. The renter may be required to hire a professional security guard, selected
by the Association, for adult and teenage parties in accordance with the
Security Guard Policy. The guard is to be present from the time the guests
arrive until the renters vacate the Clubhouse. Any exceptions must be approved
by the Board of Directors at a regularly scheduled meeting prior to the date
of the rental.
3. All
reservations for a member’s exclusive
and private use of the Clubhouse must be made with the Homeowners' Liaison.
No reservation shall
be considered binding until a Rental Agreement has been signed, approved
and the required deposit paid.
4. The Clubhouse in not available to outside organizations nor to an individual
member on behalf of an outside organization, unless the member is willing
to accept total responsibility for the organization and will be present during
the rental period. The Board of Directors must approve exceptions.
5. Under no circumstances shall the Clubhouse be available for revenue producing
functions except upon the prior approval of the Board of Directors.
6. While the maximum number of persons allowed in the facility at one time
is 200, the Clubhouse is restricted to 100 persons for dining or any other
functions where the room is obstructed by tables and chairs.
7. Reservations made within 30 days of the reserved date shall be accompanied
by full payment of the rental fee and security deposit in advance. Reservations
made more than 30 days before the reserved date shall be accompanied by the
damage deposit. Payment of the rental fee must be received at least 10 days
prior to the reserved date or the reservation may be canceled.
8. Full refunds of advance deposits will be made if the reservation is canceled
more than 10 days prior to the reserved date. No rental fee refunds will
be made when a cancellation is received 10 or less days before the reserved
date.
9. A security deposit of $400.00 is required. This deposit will not be refunded
unless all provisions of the contract have been followed and no damage is
incurred to Clubhouse facilities or furnishings. If damage occurs, the deposit
will be applied towards the cost of damage, but shall in no way limit liability
of the renter for damage or clean up costs in excess of $400.00 Standing
water or ice will severely damage the wood floor.
10. The
renter is to be aware that the Homeowners’ Liaison and/or
Board of Directors may access the function at any time to determine if the
rental is in accordance with the Rental Agreement and Policy. Failure on
the part of the renter to comply with the Rental Agreement and Policy can
result in termination of the function at any time by the President, Homeowners’ Liaison,
any board member and/or police. Should such action be required, the renter
waives his/her right to a refund of the rental fee.
11. Renters may rearrange the furniture if necessary. Please lift the furniture
as pushing or pulling will damage the furniture and the wood floor. Return
everything to its original position before leaving. Do not move any furnishings
or furniture outside.
12. Decorations
will be coordinated with the Homeowners’ Liaison to
avoid damage to wood or wallpaper. All decorations must be non-flammable
or treated with a flame retardant. Use of stick-on name tags is prohibited.
Glitter/confetti is not allowed in the Clubhouse. Glitter is extremely difficult
to clean up and doubles the cost of cleaning. The renter will be assessed
the additional cost if it is used.
13. Clean-up is to be done during the rental period (before leaving) unless
other arrangements have been made in advance. The renter is expected to take
out of the building everything he/she brought in. All garbage must be placed
in the dumpster outside and cans relined. If the renter has cans or bottles
they wish to recycle, he/she must take them out of the Clubhouse and recycle
them. Please do not leave anything in the refrigerator. Scatterings of trash,
bottles, etc. on the grounds around the Clubhouse will be considered as damage.
The room must be broom swept and all garbage picked up. Spills are to be
wiped up the same evening from counters or floors. Please check the bathrooms
prior to leaving to ensure that paper waste is not strewn about and that
toilets are flushed. The cleaner will mop the floors and clean the counters
in the kitchen and bathrooms.
14. Renters may use the fireplace, however, all fires must burn out by the
end of the rental period. Water may not be used to extinguish fireplace fires.
15. Renters may use the kitchen facilities. Clean-up needs to be done in
the kitchen before leaving the Clubhouse at the end of the rental period.
16. Renters (members) shall be fully responsible for all activities occurring
in the Clubhouse during the rental period and shall hold the Association
free and harmless of any damage or loss of personal property or any bodily
injury suffered during or as a result of a rental. The renter, the person
signing the rental agreement, must be present during the rental.
17. Any violation of alcohol and drug laws will be grounds for immediate
termination of the event. It is the responsibility of the renter to monitor
the consumption level of his/her guests.
18. The
maximum time allowed per rental is 8 hours. All functions shall be concluded
by midnight. This includes clean-up. Failure to comply with
this policy will result in an additional charge of $100.00 per hour after
midnight or any portion thereof.
19. Upon leaving, turn off all lights and heaters. Secure and lock all doors.
Make sure all trash has been taken to the dumpster and the trash cans are
relined. A charge of $25 per violation will be assessed.
20. Keys need to be returned promptly. The security deposit will then be
refunded providing no damage has occurred. The fee for a lost key is $150.00.
21. The phone number for the Clubhouse is (925) 837-3024. If a caller asks
for Greenbrook information, please ask them call back during office hours.
22. Scouting and other Greenbrook sponsored groups or functions are not
affected by the fee schedule.
23. All of the Insurance requirements on the Rental Agreement must be met
and the Release of Liability and Indemnification clause must be signed.

Any forfeited checks not honored by the bank with be subject to a $25.00
service charge and, if not paid, damages three times the amount of the check,
as allowed by California law.
Deposit and Proof of Insurance:
Undersigned
shall provide written evidence of Liability Insurance to the Greenbrook
Homes Association prior to the issuance
of keys for the rental.
Liability Insurance may take the form of either Comprehensive Personal Liability
Insurance (“CPL” or Commercial General Liability Insurance (“CGL”).
In either case the undersigned shall be the Named Insured on the policy.
The Limit of Liability shall be not less than $500,000 Each Occurrence, and,
if CGL, not less than $500,000 Each Occurrence and $500,000 in the Annual
Aggregate Limit. Acceptable evidence of liability insurance coverage for
CPL shall be a copy (photocopy or facsimile) of the most current policy Declarations
Page, showing Named Insured, Insurance Company, Policy Number, Expiration
Date and Liability Limit(s). For CGL, evidence of coverage shall be in the
form of a completed and signed original Certificate of Liability Insurance,
industry ACORD Form #25 or equivalent.
Release of Liability: The undersigned, intending is to be legally bound,
does hereby waive and release forever any rights or claims for personal injury
or damages which might otherwise arise against the Greenbrook Homes Association
and its directors, officers, members or employees from use of the clubhouse
and related facilities.
Indemnification/Hold Association Harmless: The undersigned, in consideration
of being allowed to use the clubhouse and related facilities, agrees to provide
evidence of liability insurance protection during term of use of not less
than ($500,000.00), as outlined above and to indemnify and hold harmless
Greenbrook Homes Association, its directors, officers, and members, and their
successors and assigns, employees, etc., from any damages sustained as a
result of claims, demands, costs, or judgments arising from use of the clubhouse
and related facilities. This waiver of claims and indemnification provisions
relate to any and all persons who are on the premises due to the presence
of the undersigned.
In the
event any legal action is instituted against the Greenbrook Homes Association,
its directors, officers, or members arising from the use of
the clubhouse described herein, the undersigned shall indemnify the Association
for any attorney's fees and/or court costs incurred in defending such action.
